Who can apply?
EOI §2, §§3.2–3.3, §16, §§17.8–9; Forms I–IV
The EOI permits legally competent persons, companies, partnerships, joint ventures, public charitable trusts, educational institutions and cooperative societies registered under the Maharashtra Cooperative Societies Act, 1960. Provide Aadhaar, PAN, residence and bank proof and the signed prescribed Forms I–IV. Entities need registration and authorised-signatory documents: board resolution, partnership certificate, trustee authority, society resolution or JV deed as applicable. Blacklisted or bankrupt applicants are barred; the declaration also addresses insolvency, professional misconduct, fraud, tax dues and conflicts. No common numerical income or domicile threshold is specified. Confirm nationality/non-resident and entity-specific requirements with MHADA; the account rule does not itself establish citizenship eligibility.
What is the earlier allottee’s right of first refusal?
EOI §1 note and §17.3
The EOI says a 26.57 sq m (286 sq ft) part of this plot was allotted on 19 September 1991. That allottee has first refusal to match the highest bid, so the highest bidder is not assured allotment. The EOI does not explain whether the advertised 258.39 sq m includes or excludes that part, how it will be dealt with if another bidder wins, or whether the matching right covers the whole plot and bid. Obtain MHADA’s written answers and the related deposit treatment before committing funds.
What must I pay before bidding?
EOI schedule, fee and account clauses
The EMD is ₹3,47,586. Separately, the application fee is ₹5,900 (₹5,000 plus ₹900 GST) and processing fee ₹1,180 (₹1,000 plus ₹180 GST), both non-refundable. Registration and document upload end 4 November at 5:30 PM IST; the EMD window is 11 November at 11:00 AM to 13 November at 7:00 PM IST. Use the applicant’s own bank account; third-party and NRI accounts are not accepted under the EOI account rule. Entities must use the entity’s account, not a member’s personal account. Duplicate or shared-account applications and incorrect documents can be rejected.
Does the land cost buy all development rights?
EOI §1, §4(g), §13 and §§18(e)–(g)
No. The printed ₹3,47,58,623 land cost uses FSI 1 at the Ready Reckoner 2026–27 rate of ₹1,34,520 per sq m. Further FSI/TDR requires premiums, permissions and MHADA NOC. The EOI requires GST on the bid amount but gives no rate; possession is conditional on payment of applicable GST. Lease rent, service charges, statutory arrears, stamp duty, registration, utilities, permissions and site works are additional. The EOI also makes the successful bidder liable for 1% TDS on the sale price under Income Tax rules; confirm how MHADA applies it with MHADA and a tax adviser. Obtain an itemised written demand.
When is the successful bidder’s price due?
EOI §4(f) and §§4(h)(4)–(6)
Acceptance is required within ten days; the EOI does not state the starting event. The payment table requires 25% within 30 days of the provisional offer letter becoming available. It also sets a 45-day first-stage limit, calling the extra 15 days a transit period in one sentence and an extension with delayed-payment charges in the next. The balance 75% is due within 60 days after the first-instalment period, with EMD adjusted against that second instalment. Clause 4(h)(4) says a final 90-day extension will be granted with prevailing delayed-payment charges, but also refers to cancellation after 180 days. Clause 4(h)(5) separately permits discretionary extensions in deserving cases. Obtain the exact dated demand, charges and final limit from MHADA.
What payment-default and withdrawal risks need clarification?
EOI §§3.4–3.5, §4(e)(III), §4(f), §§4(h)(4), (7), (12), §17.7
An offer remains irrevocable for 90 days from the last date for receipt of offers. Withdrawal, refusal, misstatement or breach can forfeit EMD. On final default, clause 4(h)(4) says EMD is forfeited and the remainder returned without interest, while clause 4(h)(7) provides for forfeiture of the deposit as well as EMD. Separately, clause 4(h)(12) allows disqualification after an adverse material change in bidder information and forfeiture of any amount already paid, without notice. Incorrect documents found after the auction can cancel allotment under MHADA Regulation 18; clause 4(f) provides a 15-day appeal to the Chief Officer. Confirm the full amount at risk. Unsuccessful EMD is refundable without interest within seven working days after the final decision; auction cancellation has a separate 15-day refund provision.
What tenure, development and transfer restrictions apply?
EOI §§6.2–6.4, §8, §12 note 5, §§15(a), (e), (f), §17.1, §18(b)
The EOI describes a 90-year lease in three 30-year periods, while clause 17.1 gives an initial 30 years with renewal under the prevailing policy. Renewal is not unconditional freehold ownership. Rent is assessed under MHADA Resolution 7110 dated 18 June 2024; the plot’s final rent demand is unstated. MHADA may raise annual rent after 30 years. Late rent attracts 18% annual interest or a later higher prescribed rate. The construction provisions conflict in timing: clause 6.4 requires a start within three months of allotment, while clause 18(b) conditions building approval on the lease deed, possession and full premium; the payment terms allow a longer period. Ask MHADA to reconcile these obligations and the reservation code before bidding. Transfer, mortgage, subletting and ownership changes require prior written consent and may attract charges.
What should be checked on site and before possession?
EOI §§10, 12, §§17.4–5, §§18(k), (n), (p)–(s)
Inspect boundaries, access, encumbrances, the 26.57 sq m earlier allotment and the developable area. The allottee bears removal of encumbrances and trees where necessary, with lawful permissions, and must obtain required NOCs. Possession requires full premium and dues, the executed and registered lease and the required documentary proof of stamp payment. No independently verified possession or development-completion date is established here. MHADA may reject, amend, postpone or cancel any bid or plot without assigning reasons.
